RE: Violation of Florida Statute 106.143

Dear Sir or Madam:

According to Broward County School Board District #4 candidate Rochelle “Shelly” Solomon Campaign Treasurer Summary Reports, the following expenses were reported:

All totaled, Solomon spent $7,500.00 on “communications” — the single largest expense (2x larger than any other) of her campaign.

All well and good if Solomon followed the letter of the law, however after considerable and research:

  • I was not able to find any mailer sent out by the Solomon campaign.
  • I interviewed Abby Freedman, the other District #4 candidate. Freedman, who made over 10,000 documented campaign calls during the month of September 2012, was also unable to locate any literature from Solomon.
  • Solomon also documents $450.00 in expenditures to Chris Leggett (9/1/2012). Leggett, a low-level Republican political operative, is associated with a conservative blog here in Broward County.
  • Most concerning, I uncovered a mailing (see attached) from a Republican leaning newsletter that promote Solomon’s campaign. This literature does not include any disclaimer from Solomon.
  • It is my opinion Leggett, on Solomon’s payroll, helped produce this mailing, a mailing paid for in part by Solomon’s campaign.

Therefore, I allege the following.

Broward County School Board District #4 candidate Rochelle “Shelly” Solomon, in willful violation of Florida Statute 106.143, spent $7,500 on campaign mailers that weren’t directly attributable to her campaign. In the end, it is my position that Solomon paid others to do her dirty work.

Violations of Florida Statute 106.143 include allow for the imposition of fines not to exceed $1,000 per incident.  This does not include the possibility of enhanced penalty provisions as provided in Chapter 106, Florida Statutes.

Given this, I respectfully request the Florida Elections Commission thoroughly investigates this allegation and to the extent permitted by State or local law or regulations, any and all penalties, sanctions, or other disciplinary actions for violations of such standards be applied forthwith.

I have also filed a copy of this complaint with the Broward County State Attorney’s Office.

Please provide our office with a case number specifically identifying this complaint in order to validate and track the investigation; thank you in advance for your cooperation.
