Based upon the contract language, the fact that Summerwinds HOA may have been incorrectly billed appears to be a subject the Town must resolve.
(1) Waste Management will pay the Town $10, 576.80 which equates to five years of service. Five years represents the application of the statute of limitations to this matter. We calculated the above amount by taking the solid waste portion of the rate ($3.49), reducing it by $.10 (3% franchise fee already paid) times 52 units for five years.
