Dear Mr. City Attorney;
Attached to this email is a copy of Commissioner Poitier’s public domain background report I requested from intellius.com. I will draw your attention to page 5 and 6 of this document, where you will take note that Commissioner Poitier is declared a manager of the Westside Deerfield Businessman Association.
Attached herein is a copy of Resolution 2009/003, signed by Mayor Sylvia Poiter authorizing $253,111.00 for home rehabilitation in the City of Deerfield Beach. This project was to actively advertise and recruit through Deerfield Beach’s Community Housing Development Organization (CHDO). Deerfield Beach’s CHDO is Westside Deerfield Businessman Association.
Attached herein is a copy of Commissioner Poitier’s 2009 Annual Disclosure Report. In this report, Commissioner Poitier does not declare any interest in the Westside Deerfield Businessman Association.
It is my opinion that Commissioner Poitier has intentionally violated Sec. 2-502 of the City of Deerfield Beach Ethics Code,
Sec. 2-502. Required and prohibited conduct.
(a) No member of the city commission or city manager (hereinafter referred to as "regulated officers") shall use their official position or office, by either taking any action or failing to take any action, or participate in any commission discussion, in a manner calculated to obtain a personal financial benefit not shared by a substantial portion of the public or an affected class or special private gain for himself/herself, or a principal, by whom he/she has been retained, or for the special private gain of any of the following:
(1) Himself or herself;
Therefore, I am officially filing a City of Deerfield Beach Ethics violation complaint against Commissioner Sylvia Poitier for violating Sec. 2-502.
It is my intention to file a formal criminal complaint with the Florida Department of Law Enforcement, the Florida Ethics Commission, and the Broward State Attorney Office in this matter.
